New Chile Compra supplier registry comes into effect

As reported a previous news alert, the second phase of Law 21,634, which reforms Chile's Public Procurement Law ("NLCP"), will come into effect on December 12, 2024.

Among the relevant aspects that will come into force on that date is the new Supplier Registry at www.mercadopublico.cl.

In this regard, and in accordance with the provisions of Article 16 of the NLCP, registration in the Supplier Registry and being enabled therein is a requirement to be able to participate in any procurement procedure and sign the final contracts. Consequently, not being registered in the Supplier Registry, or not having all the information required by it, could prevent participation in the tender processes that are called for as of December 12. 2024.

In this context, Chile Compra - the entity in charge of the www.mercadopublico.cl website - has already enabled the first modifications to make the Supplier Registry operational. Among the information required, there is the obligation to sign the Supplier Registry Affidavit (which replaces the current Declaration of Partners and Administrators).

We would like to point out that it is very important that if you are a user of www.mercadopublico.cl, you need to complete this affidavit and all the information required. As we indicated, the incompleteness of the information required in the Supplier Registry could prevent participation in the tender processes that are called for as of the date indicated above.
