His practice focuses on civil and commercial litigation both before ordinary courts as well as special litigation and alternative dispute resolution.
REPRESENTATIVE EXPERIENCE
- WOM, the second largest mobile telecommunications provider in Chile, and several of its related entities in Chile, Norway and Luxemburg, on its voluntary reorganization proceeding under Chapter 11 of the U.S. Bankruptcy Code, filed in the Bankruptcy Court for the District of Delaware, which included the negotiation and execution of a senior secured debtor-in-possession (DIP) financing, for up to USD210 million, granted by JPMorgan Chase Bank.
- Nova Austral and its shareholders on the reorganization proceedings in relation to their aquaculture activities in southern Chile, following investigations by the local fishing authorities and environmental complaints against them.
- Valle Nevado, a leading Chilean ski center and resort, on the implementation plan for the restructuring of a debt for USD60 million.
- Empresas Sencorp, one of the largest real estate and construction groups in Chile, on several matters related to the insolvency of the group, including the reorganization of its main subsidiaries, the renegotiation of its holding-level debt, the liquidation of certain subsidiaries, and the conflicts with its partners in other affiliates.
- Constructora Proyekta on various aspects related to an insolvency proceeding, due a complex financial situation that affected the entire construction industry, especially the increase in the cost of materials.
- Itaú Corpbanca on the restructuring of the existing debt of Inversiones Hoteleras Holding (IHH) with Itaú Corpbanca, in the context of the sale, by IHH, of all the outstanding shares in Inmobiliaria Cerro San Cristóbal (Hotel Sheraton) to Inversiones Hoteleras C y A (Grupo Alcázar).
- The estate of a natural person, on one of the first cross-border insolvency proceedings since the enactment of the Insolvency Law in 2014 in Chile. The advice included the recognition of a bankruptcy proceeding held before the Bankruptcy Courts of Atlanta, GA, USA, with the objective of obtaining a judicial permission for the sale of land owned by the debtor in the vicinity of La Serena, Chile
- Liberty and Mapfre, both insurance companies, on an arbitration against EPI, a state-owned port company, and ITI, a private concessionnaire of Iquique's port, regarding the payment of an additional USD18 million indemnization over the USD33 million previously paid in agreement with the adjuster, for damages suffered by the port of Iquique due to an earthquake.
